Individuals serving a state sentence may be granted release from prison followed by a period of probation or may be released followed by a period of Special Parole. Individuals granted release with a period of special parole remain under the jurisdiction of the Board of Pardons and Parole and face easier likelihood of being convicted for violation of parole. Individuals facing charges for probation\/parole violation do not have a right to a jury trial and the status of proof of “Beyon a Reasonable Doubt” does not apply.<\/p>\n

Post Incarceration (federal criminal justice system)<\/strong><\/p>\n

Individuals serving a federal sentence may be granted a period of supervised release from prison. However, individuals who violate the terms and conditions of their Supervised Release will face up to five additional years in prison and do not have a right to a jury trial of these violations.<\/p>\n

Prior Arrests and Probation Violation<\/strong><\/p>\n

Once individuals are granted probation release from jail, they must comply with each condition of probation, which may include both “standard” and “special conditions. Failure to report to probation officer, being arrested for crime or failure to comply with other conditions of release will result in charges for probation violation. Once an arrest warrant is signed for probation violation and the period has tolled it does not resume until the matter is resolved.
\nA prior crime of arrest dated before the person is place on probation, does not constitute violation of probation and will not impact release on probation.<\/p>\n
