Federal Sentencing Guidelines
In the federal court system, there are Federal Sentencing Guidelines that set forth minimum and maximum sentences to be imposed for federal crimes. While they are no longer binding upon federal judges, they may use their discretion in complying with the Guidelines. However, judges do look to them at the time of position of sentencing. The level of offense and prior criminal history determine the sentence under the Federal Sentence Guidelines. Individuals facing charges for a crime (or similar crime) which they have previously been convicted are considered second or subsequent offenders. Second offenders may face the maximum penalty for the federal crime for which they are convicted.
